Everyone who is arrested and allowed to post bail has the option of paying the full bail amount in cash. Under Florida Law, posted cash bail may be applied against any outstanding fines, costs, fees, or other court and criminal penalties, even if it is posted on behalf of another person instead of by the defendant. In some situations, the court may decide to set a cash only bond, which must be paid in full in order to post bail. Often, a court will order a cash-only fee if the defendant is considered to be high-flight risk, if he or she has a warrant for arrest in another jurisdiction, or if he or she has an unpaid court balance. Cash bail cannot be paid as a bail bond.
If the defendant follows court procedure and appears at all hearings and trials, the court will hold the cash bail until the completion of the defendant's case, at which point it will be refunded, less any fines and fees. If, however, the defendant fails to appear, the court will give the bail bond agent 6 months to locate the defendant and surrender him or her to the court. Should there be a legitimate reason for the failure to appear, such as an unavoidable emergency or a misunderstanding, the court may choose to reschedule the court date. In the event that the bail bond agent is unable to find or surrender the defendant, then the cash bail is forfeited.
